CFTC probes Polymarket over alleged breach of 2022 US user ban settlement

Published Oct 27, 2026Updated 10h ago

The Commodity Futures Trading Commission (CFTC) is investigating whether Polymarket violated a 2022 settlement that required the prediction market operator to ban US users from its platform. The probe centers on whether Americans continued trading on Polymarket's offshore platform despite the agreement. Polymarket paid a $1.4 million fine under the 2022 settlement. The company acquired CFTC-licensed exchange QCEX in 2025 and now operates in the US under a CFTC order of designation.

Why this matters?

Polymarket's 2025 acquisition of QCEX was meant to bury its unlicensed past, but the CFTC probe reopens exactly that history. If the agency finds a breach, settlement penalties could include heavier fines or operating restrictions on the US exchange. Rivals like Kalshi and ForecastEx will exploit any compliance setback to capture market share.

The investigation also tests whether CFTC-registered platforms can outrun their pre-licensing conduct. House Oversight has already expanded insider-trading probes across five platforms. A second credibility blow to Polymarket would strengthen momentum for mandatory surveillance legislation every competitor must then fund.
