EU watchdog flags market manipulation risk in prediction markets

The European Securities and Markets Authority (ESMA) warned Thursday that prediction markets carry elevated market manipulation and insider trading risks. The EU watchdog said an abrupt market correction is possible. ESMA also flagged prediction markets as a crypto-tied risk to traditional finance, alongside tokenized equities and DeFi exploits, in a broader assessment of systemic threats from crypto integration. The regulator cited growing crypto connections as an amplifier of risk to the broader financial system.

ESMA's warning lands the same week as a CFTC-DOJ insider-trading charge against a Google engineer on Polymarket, and just days after CME's Duffy demanded stricter surveillance rules at the first event-contract advisory meeting. European and US regulators are now sounding the same alarm in parallel, raising the compliance bar on both sides of the Atlantic. Platform operators with cross-border users must build detection systems that satisfy two distinct rulebooks.

The EU framing of prediction markets as crypto-adjacent systemic risks could trigger MiCA-style licensing requirements that American venues do not face. For Kalshi and Polymarket, diverging regional standards mean engineering teams must maintain dual surveillance stacks or exit one market. Traders benefit from cleaner markets, but the cost of building them will show up in tighter spreads or higher fees.
