An Illinois federal panel ruled that Kalshi's sports event contracts are not swaps under the Commodity Exchange Act. The October 5 decision applies a different legal test than the Sixth and Ninth Circuits have used, widening a federal circuit split over how to classify CFTC-registered sports-linked event contracts. Robinhood was also mentioned in the same context. The ruling gives Kalshi a win in Illinois but adds to the patchwork of conflicting standards across states.

Why this matters?

Kalshi just gained a clean federal classification in Illinois that conflicts directly with the Sixth Circuit's opposite holding on Ohio and Tennessee sports contracts. That Sixth Circuit ruling forces Kalshi to geofence those markets while Illinois stays open, fragmenting the same product across state lines. Polymarket and other CFTC-registered platforms face the identical split since no single circuit's test controls nationally.

Traders now hold sports contract positions whose federal legality shifts based on geography, not regulation. The Illinois panel's stricter analysis also invites appeal, so this win may not hold. Kalshi must fund parallel litigation tracks in multiple circuits while state attorneys general copy whichever precedent favors local gambling law. Only a Supreme Court resolution would unify the standard, but the pending cert petitions from New Jersey, Robinhood, and Crypto.com offer no near-term relief.
