CFTC intermediary files 2nd Circuit brief as agency event-contract rule nears publication
A CFTC-registered intermediary filed its opening brief in the Second Circuit defending event contracts against legal challenge. The filing comes as a separate CFTC proposed rule on event contracts is set for Federal Register publication on Monday, October 19. The rule covers sports, politics, and cultural event contracts. The agency is also seeking public comment on crypto asset transactions and event contracts in a parallel proceeding.
The Second Circuit brief and the pending rule publication put the CFTC on two tracks at once: defending existing contracts in court while rewriting their regulatory classification. A swaps label would force Kalshi and Polymarket to restructure or pull products that cannot meet traditional derivatives requirements. State courts in Ohio and Tennessee have already stripped Kalshi's federal preemption shield under gambling framing.
The CFTC rulemaking stretches across months while state attorneys general move in weeks, copying each victory as template law. Platforms now fund parallel legal spend on federal comments, state defense, and possible product redesign. The first operator to lose another major state case sets the compliance cost every competitor must match through geofences, redesign, or retreat.
Adds a Second Circuit defense to the agency's existing rulemaking push and Kalshi's Sixth Circuit rehearing petition, deepening the judicial overlap where federal preemption is under assault in multiple circuits.
