Utah sues Kalshi calling reduction markets a public nuisance
Utah filed a lawsuit seeking to halt Kalshi's operations in the state, Axios Salt Lake City reported. State officials argue that Kalshi's event contracts constitute illegal gambling under Utah law. The suit specifically labels the prediction market platform's reduction markets a public nuisance. The action challenges Kalshi's ability to offer contracts to Utah residents. It adds to state-level legal challenges facing CFTC-regulated prediction market platforms as they expand nationally.
Kalshi's federal preemption shield is now pierced in Utah after its August loss on federal preemption, joining Ohio and Tennessee where courts already stripped the same protection. Each new state suit multiplies defense costs and fragments national markets into geofenced patches where contracts trade in some states but not others. The NFL has backed state gambling framing at the Supreme Court, deepening the headwind.
Kalshi must now choose between expensive geofences, product redesign, or fighting parallel suits without guaranteed federal backup. The CFTC's pending swap-rule proposal remains in White House review, slower than courtroom clocks where platforms are losing. Susquehanna's naming in the Utah complaint also drags a major trading firm into the liability chain, adding counterparty risk to the compliance burden.
Becomes the fourth state-level suit against Kalshi's federal preemption shield, after Ohio, Tennessee, and Utah's earlier action naming Susquehanna, with Missouri now also facing federal preemption litigation from Crypto.com and Novig.
