NYC Council probes Coinbase, Polymarket, Kalshi, and Gemini Titan on prediction market ads
The New York City Council opened an investigation August 12 into Polymarket, Kalshi, Coinbase, and Gemini Titan over the platforms' prediction market marketing practices. Council Speaker Julie Menin sent letters containing more than 60 questions covering revenue figures and operations. The council characterized the marketing as deceptive, predatory, and potentially harmful to young people. The probe was announced as the CFTC has moved to protect prediction market activity from state-level crackdowns.
The council's minor-targeting frame is the most toxic vector in political marketing. No platform survives being branded a child-gambling conduit. Kalshi and Polymarket must now defend on three enforcement layers — city, state, and federal — with the fastest-moving layer setting the operational ceiling. Coinbase's inclusion extends reputational risk beyond its core exchange into prediction market adjacencies.
The 14-day data demand means immediate compliance cost and potential evidence for both the council and the parallel state attorney general lawsuit. A council hearing that produces damaging testimony could trigger copycat municipal probes before any federal standard resolves. The platforms lack leverage to shape city rules.
The council investigation adds a fourth enforcement front to the state-by-state litigation already eroding CFTC-registered platforms' federal preemption shield.
